The H-1B cap has been reached since November 22, 2011.

The earliest date to file H-1B with U.S. Immigration will now be April 1, 2012. You cannot utilize the H-1B(even if approved), until October 1, 2012.

Therefore it is imperative you remain in lawful status until October 1st 2012.
